Terms of service

These Terms and Conditions govern the purchase of products through the Work & Chill online store. By placing an order, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions.

This agreement is perfected once the price of the merchandise has been paid, accepted, and recognized by Work & Chill’s payment systems. Once payment has been verified, Work & Chill will process the order and deliver the selected products to the address provided by the customer, subject to the terms stated below.

I. Age Restrictions

Purchases may only be made by individuals who are 18 years of age or older. Individuals under 18 years of age may only make a purchase through a parent, legal guardian, or person legally authorized to act on their behalf.

II. Conditions of Purchase

Customers may only purchase products that are available for sale and whose details appear in the online store at the time of purchase.

Product details, including prices, available colors, sizes, materials, and quantities, are specified in the online store and may vary depending on availability.

Products purchased through Work & Chill are intended for the customer as the final user. The resale or commercialization of products purchased outside authorized channels is not permitted and may result in legal action.

III. Product Availability

All products listed in the Work & Chill online store are offered according to available inventory, materials, colors, sizes, and production capacity at the time of purchase.

Work & Chill makes every effort to keep product availability updated. However, availability may vary due to demand, production processes, inventory adjustments, or operational factors.

If an item becomes unavailable after the order has been placed, Work & Chill may contact the customer to provide available options.

IV. Product Representation

Work & Chill makes every effort to display product colors, textures, fit, and details as accurately as possible.

However, colors may vary slightly depending on screen settings, device display, lighting, photography, editing, or individual perception. These variations do not constitute a product defect.

Product images, descriptions, and measurements are provided for reference purposes. Slight variations may occur due to the nature of garment production, fabric behavior, manual processes, or manufacturing tolerances.

V. Garment Care

Customers are responsible for following the care instructions provided with the garment or indicated by Work & Chill.

Work & Chill is not responsible for damage caused by improper washing, drying, ironing, bleaching, stain treatment, use of chemicals, excessive heat, friction, misuse, negligence, or failure to follow care instructions.

Damage resulting from improper care does not constitute a manufacturing defect and will not be eligible for exchange, refund, return, or replacement.

VI. Prices, Promotions, and Discounts

Prices, promotions, discounts, product availability, and campaign conditions may change at any time without prior notice.

Work & Chill does not apply retroactive discounts, refunds, credits, or price adjustments to orders placed before or after a promotion, discount, sale, or campaign.

Promotional products, discounted items, clearance items, and Final Sale products are subject to specific conditions and restrictions stated in these Terms and Conditions.

VII. Placing an Order

To make a purchase, the customer must enter the Work & Chill online store at www.workandchill.com, select the desired product or products, and complete the corresponding purchase process.

During checkout, the customer will be required to provide personal and contact information, including an email address and shipping address. The customer is responsible for ensuring that all information provided is complete and accurate.

Work & Chill is not responsible for delays, failed deliveries, returned packages, or additional costs caused by incorrect, incomplete, or inaccurate information provided by the customer.

VIII. Order Summary and Confirmation

The products selected by the customer will be included in the shopping cart. Before completing the purchase, the customer will be able to review the order summary, including product description, price, quantity, size, color, shipping information, and total amount.

It is the customer’s responsibility to review the order carefully before submitting payment.

Once the order is placed, Work & Chill will send an email confirming receipt of the order. This first confirmation does not constitute final acceptance of the order until payment has been authorized and approved.

IX. Payment Methods

Customers may pay using the payment methods available at checkout, including credit or debit cards such as Visa, MasterCard, and American Express, subject to availability.

Payments may also be made through other payment methods enabled in the online store or previously authorized by Work & Chill.

Card payments are processed through secure third-party payment platforms. Work & Chill does not store full card details or sensitive payment information.

X. Payment Authorization and Order Processing

When paying by credit or debit card, Work & Chill will request payment authorization from the corresponding payment processor. If the payment is not authorized, the order cannot be completed.

The customer acknowledges and agrees that the full amount of the order must be paid before the products are processed and shipped.

Once payment has been approved, the order will enter Work & Chill’s validation, preparation, and fulfillment process.

XI. Shipping and Delivery Policy

At Work & Chill, we are committed to processing and shipping every order as quickly as possible. However, due to the nature of our production, preparation, and logistics processes, all delivery times are estimates only and may vary.

Order Processing

Once the purchase has been confirmed, the order will enter our system for validation and preparation.

Order processing may take between 1 and 10 business days, depending on garment availability, order volume, production capacity, and operational workload at the time of purchase.

After processing, the order may require an additional 1 to 3 business days for packaging, shipping label generation, and carrier pickup.

Once the package has been collected by the carrier, the estimated transit time is 2 to 5 business days, depending on the shipping destination and the carrier’s delivery process.

Important Shipping Considerations

All delivery times are estimates and do not guarantee a specific delivery date.

Shipping times may be extended due to external factors such as high demand, carrier delays, weather conditions, customs procedures, inspections, holidays, force majeure events, or any other circumstances beyond Work & Chill’s control.

For international shipments, packages may be subject to customs processes, inspections, import procedures, or additional requirements from the competent authorities. These processes and timelines are not controlled by Work & Chill.

For personalized, embroidered, or made-to-order products, processing times may be extended. These timelines are also estimates and may vary depending on production capacity and order volume.

Work & Chill is not responsible for delays caused by shipping carriers, customs authorities, third-party logistics providers, or any other third party involved in the transportation and delivery process.

By placing an order, the customer accepts these shipping and delivery conditions and acknowledges that processing and delivery times may vary.

XII. International Duties, Taxes, and Customs Fees

International orders may be subject to customs duties, import taxes, brokerage fees, handling fees, or additional charges required by the destination country.

These charges are determined by local authorities, customs offices, shipping carriers, or third-party logistics providers and are the responsibility of the customer, unless otherwise expressly stated by Work & Chill.

Work & Chill is not responsible for customs duties, import taxes, brokerage fees, handling fees, delays, inspections, package holds, or any additional charges imposed by the destination country or shipping carrier.

If the customer refuses to pay customs duties, import taxes, or any required fees, and the package is returned, abandoned, delayed, or destroyed, Work & Chill will not be responsible for refunds, replacements, shipping costs, or any additional charges generated.

Customers are responsible for reviewing the import regulations, taxes, and customs requirements of their country before placing an order.

XIII. Shipment Tracking

Once the order has been shipped, the customer will receive a shipping confirmation email with tracking information, when available.

The customer may track the shipment using the tracking number provided by the carrier.

Once an order has been handed over to the carrier, the delivery process is managed by the shipping carrier. Work & Chill will assist the customer in reviewing the status of the shipment when necessary, but carrier transit times and delivery operations are outside Work & Chill’s direct control.

XIV. Delivery Attempts and Returned Packages

Courier companies may make multiple delivery attempts, depending on their own delivery policies and procedures.

If the customer is not available to receive the package, provides an incorrect or incomplete address, refuses the delivery, fails to collect the package, or does not respond to the carrier’s delivery attempts, Work & Chill will not be responsible for delays, failed delivery, return shipping costs, reshipping costs, storage fees, customs fees, or additional charges that may arise.

If a package is returned to Work & Chill due to an incorrect or incomplete address, failed delivery attempts, refusal of delivery, failure to collect the package, unpaid customs duties or taxes, or any other reason attributable to the customer, the customer will be responsible for any additional shipping costs required to resend the order.

Original shipping costs are non-refundable.

XV. Lost, Missing, Delayed, or Stolen Packages

Once an order has been shipped and handed over to the carrier with a valid tracking number, the delivery process is managed by the shipping carrier.

If a package is delayed, missing, or suspected to be lost, Work & Chill will assist the customer by opening a formal investigation or claim with the carrier.

Refunds, replacements, or resolutions cannot be processed until the carrier provides an official determination confirming the final status of the shipment.

If the tracking information shows that the package was delivered to the address provided at checkout, Work & Chill is not responsible for packages that are lost, stolen, misplaced, removed, or damaged after delivery.

Each case will be reviewed based on the carrier’s investigation and final determination.

XVI. Returns, Refunds, and Exchanges

Work & Chill does not offer refunds.

Work & Chill does not accept returns under any circumstances. Only exchanges may be allowed, and they are subject to the conditions stated in this policy.

Exchanges are only available for eligible regular-priced products and may only be related to size changes of the same purchased model, subject to availability.

We strongly recommend that customers review the size guide and confirm their measurements before placing an order.

XVII. Defective or Incorrect Products

If the customer receives a defective or incorrect product, they must notify Work & Chill within 48 hours of receiving the order.

The customer must contact envios@workandchill.com or WhatsApp +52 477 881 0222 and provide photographic evidence, order details, and a description of the issue.

This policy does not apply to items that have been intentionally altered, used, washed, stained, damaged, painted, faded, or handled in a way that affects their original condition.

All cases will be reviewed by Work & Chill before any resolution is approved.

XVIII. General Exchange Conditions

To request an exchange, the customer must contact Work & Chill within 5 business days after the delivery date.

The item must be in new and optimal condition, unworn, unwashed, unstained, unaltered, and with all original tags intact.

The customer is responsible for the cost of return shipping and the shipping fee for the new item.

Once the exchange request is received, Work & Chill will provide return instructions. After the item is received and inspected, Work & Chill will notify the customer whether the exchange has been approved.

If the requested size is not available, the waiting time for restocking may vary and is not guaranteed.

XIX. Products Not Eligible for Exchanges

The following products are not eligible for exchanges, returns, cancellations, or refunds under any circumstance:

  • Personalized products
  • Embroidered products
  • Products made or adjusted by special request
  • Products purchased on sale, promotion, discount, or clearance
  • Final Sale items
  • Items that have been used, washed, stained, damaged, altered, or returned without tags

Items purchased on sale, promotion, discount, or clearance are considered Final Sale.

Embroidered products are considered personalized and are not eligible for exchanges, returns, cancellations, or refunds.

XX. Restrictions on Discounted Products

Products purchased at a discount, on promotion, or on sale are not eligible for embroidery customization.

Any embroidery request for discounted or promotional products may not be processed. If embroidery was added to an order that is not eligible for customization, the corresponding cost will not be refunded.

This restriction is due to order processing logistics, production limitations, and the limited availability of promotional products.

XXI. Cancellations and Modifications

Once a purchase order has been processed by Work & Chill, it cannot be canceled or modified.

This includes, but is not limited to, changes in size, color, model, shipping address, embroidery details, or order quantity.

The customer is responsible for reviewing all order information before completing the purchase.

XXII. Rescission of Purchase

A breach of these Terms and Conditions, either by Work & Chill or by the customer, may be considered a resolutive condition for the validity of this agreement.

If a breach by Work & Chill is not cured and the customer does not accept the proposed corrective action, this agreement may be terminated in accordance with applicable law, without the need for prior judicial resolution, when legally applicable.

If the payment processor does not authorize payment due to suspected fraud, insufficient funds, stolen card reports, invalid payment details, or any other reason, the purchase will not be completed. Work & Chill may notify the customer through the email provided during checkout.

XXIII. Customer Service and Contact Information

Work & Chill will respond within a maximum period of 48 business hours from receipt of the claim, question, or complaint.

For order status inquiries, the customer may be asked to provide their order number, full name, email address, and any other information necessary to locate the order.

XXIV. Limitation of Liability

Work & Chill will not be liable for indirect, consequential, incidental, or special damages arising from the use, misuse, or inability to use its products.

This includes, but is not limited to, damages caused by misuse, negligence, unauthorized alterations, improper washing, incorrect drying, incorrect ironing, incorrect sizing selection, chemical exposure, or uses different from those recommended.

Work & Chill will not be responsible for delays, damages, losses, failed deliveries, returned packages, additional fees, customs charges, carrier issues, or delivery issues caused by shipping carriers, customs authorities, third-party logistics providers, incorrect customer information, force majeure events, or circumstances beyond its reasonable control.

XXV. Applicable Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Mexico, without regard to conflict of law provisions.

The Federal Consumer Protection Agency, Procuraduría Federal del Consumidor, may have administrative jurisdiction to resolve disputes arising from the performance of this agreement under the terms and cases provided by the Federal Consumer Protection Law.

Any dispute arising from these Terms and Conditions or their performance shall be resolved exclusively by the competent courts located in León, Guanajuato, Mexico, which shall constitute the sole venue for any dispute, unless otherwise required by applicable law.

If any part of these Terms and Conditions is determined to be unlawful, invalid, or unenforceable, such part shall be severed and shall not affect the validity and enforceability of the remaining provisions.

Work & Chill may modify these Terms and Conditions by updating this publication and, when applicable, following the corresponding registration or authorization procedures before the competent authorities.

XXVI. Privacy

Work & Chill may collect personal data from customers during the purchase process in order to process orders, verify payments, arrange shipping, provide customer service, and fulfill legal and operational obligations.

XXVII. Acceptance of Terms and Conditions

By placing an order, the customer declares that they have read, understood, and expressly accepted these Terms and Conditions.

The purchase constitutes the customer’s express, binding, and definitive acceptance of these Terms and Conditions, including the shipping and delivery policy, exchange policy, cancellation policy, product availability policy, international duties and taxes policy, garment care policy, and all limitations stated herein.

The customer acknowledges that processing and delivery times are estimates only and may vary due to production, availability, logistics, customs, carrier operations, holidays, high demand, force majeure events, or circumstances beyond Work & Chill’s control.

The customer also acknowledges that Work & Chill is not responsible for delays, customs fees, import taxes, delivery issues, failed delivery attempts, returned packages, or additional charges caused by third parties, customer-provided information, or circumstances outside Work & Chill’s control.
